This is a starting point drafted to describe how 365Coachly actually works. It has not been reviewed by a lawyer. Have it reviewed before taking payments from the public, particularly the sections on refunds, creator payouts and data handling.
1. What 365Coachly is
365Coachly is a marketplace. Coaches sell training programs, coaching, challenges, meal plans and subscriptions directly to clients. We provide the storefront, checkout, content delivery and payouts.
We are not the coach. Coaches set their own prices, write their own programs and are responsible for the quality, safety and accuracy of what they sell. Your contract for the training itself is with them.
2. Health and safety
Training carries risk of injury. Nothing sold on 365Coachly is medical advice, and coaches are not your doctor. Consult a qualified professional before starting any programme, particularly if you are pregnant, injured, or managing a health condition.
You train at your own risk.
3. Accounts
You must be at least 18, or have consent from a parent or guardian. Keep your password secure — you are responsible for activity under your account. Tell us immediately if you suspect unauthorised access.
4. Payments and the platform fee
Payments are processed by Stripe. We never see or store your card details.
365Coachly takes a 10% platform fee on every transaction, including subscription renewals. The coach receives the remaining 90%, less Stripe's processing fees. The price you see at checkout is the price you pay — the fee is already included, not added on top.
5. Subscriptions and renewals
Subscriptions renew automatically at the interval shown when you subscribe, until cancelled. The renewal date and amount are shown before you pay and in your dashboard at all times.
You can cancel any time. Cancelling stops future charges and you keep access until the end of the period you have already paid for. We do not pro-rate partial periods.
For annual subscriptions we email you at least 7 days before each renewal.
6. Refunds
Digital content can be consumed immediately, so refunds are handled case by case. Contact the coach first — most issues are resolved directly. If that fails, contact us and we will mediate.
Refunds reverse both the coach's payout and our platform fee, and access to the refunded content ends.
7. What coaches agree to
Coaches keep ownership of their content and grant us the licence needed to host, display and deliver it to buyers. Coaches confirm they have the right to sell what they list, and that it is their own work.
Payouts are handled through Stripe Connect. Coaches must complete Stripe's identity verification before selling, and are responsible for their own taxes.
Taking transactions off-platform to avoid the platform fee — after meeting a client through 365Coachly — is grounds for removal.
8. Acceptable use
Do not use 365Coachly to:
- sell content you do not own or have rights to
- make medical claims, or promise specific physical results
- harass, threaten or abuse other users
- share purchased content with people who have not bought it
- scrape, reverse-engineer or attack the service
9. Content shared in messaging
Progress photos and messages between a client and coach are private to those two people. Coaches must not share, publish or reuse a client's photos without that client's explicit written permission.
10. Suspension
We may suspend or remove accounts that breach these terms. Where money is involved we will settle outstanding balances owed to a coach, minus any refunds or chargebacks.
11. Liability
365Coachly is provided as-is. To the extent permitted by law, our liability is limited to the fees we collected from you in the 12 months before the claim.
We are not liable for injury arising from training, or for disputes between a coach and a client about the quality of coaching.
12. Changes
We may update these terms. Material changes will be notified by email at least 14 days before taking effect. Continuing to use 365Coachly after that means you accept the updated terms.
